These terms govern your use of Relay Nine, an independent browser arcade operated at civaroq.com. They are written to be readable: the games are free, run locally, and require no account, so the rules below are correspondingly simple.
Acceptance of Terms
Welcome to Relay Nine (the “Service”), operated at civaroq.com. These Terms of Use form a legally binding agreement between you and Relay Nine (“we”).
- By accessing, browsing, or using the Service in any way, you confirm that you have read, understood, and agreed to be bound by these terms and our Privacy Policy.
- If you do not agree with any part of them, please do not access or use the Service.
- Continued use after we publish a revision means you accept the revised terms.
- If you access the Service on behalf of an organization, you represent that you have the authority to bind that organization.
Description of the Service
Relay Nine is an independent browser arcade. We publish free, original mini games together with written instructions. Every game runs locally in your browser — there is nothing to install. We do not require an account, we do not sell products, and we do not process transactions or purchases through the site. All content is provided for entertainment and informational purposes.
User Rules and Responsibilities
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. Specifically, you will not:
- Damage, disable, overburden, or interfere with the operation of the site or any other party's use of it
- Attempt unauthorized access to any part of the Service (hacking, password mining, and similar)
- Use robots, scrapers, or other automated means to access, collect, copy, or monitor content without our prior written consent
- Copy, republish, or redistribute site content beyond brief quoted excerpts with attribution and a link back (fair use and fair dealing excepted)
- Submit unlawful, defamatory, harassing, threatening, fraudulent, or privacy-invading content through the contact form
- Impersonate any person or entity
- Distribute viruses, worms, malware, or any other harmful code
- Restrict or inhibit any other visitor from using the Service
You represent that you are at least 13 years old. If you are under 18, a parent or guardian should review these terms before you play.
Intellectual Property
The original content of this site — games, source code, design, graphics, text, and the Relay Nine name and logo — is the property of Relay Nine and its licensors, protected by copyright, trademark, and other laws.
- The Relay Nine name, logo, and related marks are our trademarks.
- Some game mechanics have public-domain histories (a growing snake, a paddle duel, a numbered sliding puzzle). Those mechanics are used freely; every implementation, name, artwork, and line of writing here is original.
- You may share links to our pages and quote brief excerpts, provided you credit Relay Nine and link back to the original page at civaroq.com.
- You may not republish, copy, distribute, or modify our content, in whole or in part, for commercial purposes without our prior written consent.
Artwork and Attribution
Every game cover is an original illustration created for Relay Nine. The site currently uses no third-party stock photography and no CC-licensed images. If third-party or Creative Commons assets are ever introduced, they will be credited in this section, with copyright remaining with their respective creators.
Copyright and Takedown Requests
If you believe that content on this site infringes your copyright, send a notice to [email protected] with the subject “Copyright”, including:
- Identification of the copyrighted work you claim has been infringed
- The exact URL of the allegedly infringing content on this site
- Your full name, mailing address, email address, and telephone number
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
We will review valid notices promptly and remove or replace content where appropriate.
Independent Selection
Games are chosen for clarity, replay value, accessibility, and technical reliability. A protocol's position in the directory is not sold, and we accept no paid placements or sponsored games. The opinions in our writing are our own.
Third-Party Links
The Service may contain links to third-party websites and services (for example, Google policy pages or your own email application). We do not control and are not responsible for their content, accuracy, or privacy practices, and we are not liable for any loss arising from reliance on third-party sites.
Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of defects.
- Game content is for entertainment; it is not professional advice of any kind.
- Personal best scores are stored locally on your device and may be lost when browser data is cleared or game logic changes.
- We are not responsible for consequences of decisions made on the basis of site content.
Limitation of Liability
To the maximum extent permitted by law, Relay Nine and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill. Our total aggregate liability for any claim arising from the Service is limited to 100 US dollars (US $100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case the limits apply to the extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Relay Nine and its operators from and against claims, damages, obligations, losses, liabilities, and expenses (including reasonable legal fees) arising from (a) your use of or access to the Service, (b) your violation of these terms, or (c) your infringement of any third-party right.
Account Suspension and Termination
The Service currently requires no account. We may restrict access when reasonably necessary to protect the Service, its users, our rights, or legal compliance. If account features are introduced in the future, we may suspend or terminate accounts that violate these terms without prior notice, and you may request deletion of your account at any time by contacting [email protected]. Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability, indemnification, and governing law — remain in effect.
Changes to These Terms
We may revise these terms at any time at our discretion. Revisions will be posted on this page with an updated date, and material changes will be announced where practical before they take effect. Continued use after a revision takes effect means you are bound by the revised terms; if you disagree, stop using the Service.
Dispute Resolution
a. Informal resolution
Before starting formal proceedings, both parties will attempt in good faith to resolve the dispute for 60 days after written notice of the claim.
b. Binding arbitration
Disputes not resolved within 60 days will be settled finally and exclusively by arbitration under the consumer arbitration rules of the American Arbitration Association (AAA), except for matters eligible for small-claims court. Arbitration is before a single arbitrator, conducted in English, and the award may be enforced in any court of competent jurisdiction.
c. Class action waiver
Arbitration proceeds on an individual basis only; both parties waive the right to bring class or consolidated proceedings.
d. Equitable relief
Either party may seek injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property or confidential information, without prior arbitration.
Governing Law and Jurisdiction
These terms are governed by and construed under the laws of the United States and the State of Delaware, without regard to conflict-of-law rules. Subject to section 14, exclusive jurisdiction and venue lie with the state and federal courts located in Delaware, and both parties irrevocably submit to that jurisdiction.
Entire Agreement
These terms, together with the Privacy Policy, form the entire and exclusive agreement between you and Relay Nine regarding the Service, superseding all prior or contemporaneous agreements, communications, and understandings, whether written or oral.
Severability
If a court of competent jurisdiction finds any provision of these terms invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
Waiver
Our failure to enforce any right or provision of these terms at any time is not a waiver of that right or provision. A waiver is effective only if in writing and signed by an authorized representative.
